TERMS OF SERVICE

The following terms of service between the customer (“you”, “your”) and Selfridges Retail Limited (“we”, “our”, “us”, or “Selfridges”) governs your use of the Selfridges Rental Platform ("Terms of Service").

Selfridges Rental is an online service that allows customers to access an unlimited wardrobe to rent. Selfridges Rental allows customers to trial new designers and rent for 4, 8, 10 and 20 day periods (or any other specified period offered).

The Bag Subscription Service is an online subscription service that allows customers to rent a designer handbag per month across a three (3) or six (6) month period via the Selfridges Rental Platform.

All Users of the Services are required to read, accept and agree to comply with these Terms. If you do not wish to accept the Terms, you should not register and MUST stop using the Services immediately.

Selfridges reserves the right to accept or reject any membership application for an account to use the Services at our sole and absolute discretion.

Selfridges reserves the right to make changes to the Services and to these Terms which will not materially affect your use of the Services. Selfridges strongly recommends that you revisit these Terms each time you use the Services to familiarise yourself with any amendments. Once we have made the changes to the Services and/or these Terms, acceptance will be inferred from your continued use of the Services. In the event that we make any significant changes to the Services and/or these Terms, we will notify you in writing and provide you with an opportunity to cease use of the Services before the changes take effect.

DEFINITIONS:

“Bag”: means a designer handbag rented by a Bag Subscriber through the Bag Subscription Service from our online designer handbag collection via Selfridges Rental.

“Bag Subscribers”: means a Member who is using the Bag Subscription Service available through the Selfridges Rental Platform.

“Bag Subscription”: means a subscription to the Bag Subscription Service that has been paid for by a Bag Subscriber and commenced for either a three or six-month period.

“Bag Subscription Service”: means the designer handbag rental concept offered on a subscription basis, by Selfridges to customers via the Selfridges Rental Platform subject to these Terms.

“Bag Subscription Terms”: means the additional terms that apply to Bag Subscribers which can be found here.

“Booking Date”: the date on which you placed the order for the Rental of a Product. This is deemed to be the date the Rental was booked on the Services and as detailed in your confirmation email and account dashboard.

“Cancellation Charge”: means a cancellation charge of 30% of the Rental Fee payable by the Renter to Selfridges to cover administrative costs.

“Content”: any photos, text or any other information posted to the Services by Selfridges or Members.

“Damage Protection Charge”: means an optional £5.00 charge to cover normal wear and tear which, for the avoidance of doubt encompasses minor stains, rips, missing beads, stuck zippers or other minor damage to each Rental Product.

“Delivery Fee”: the cost for each Product to be delivered and returned as part of the Services.

“Feedback”: feedback, ideas, suggestions, documents or proposals.

“Fit Guarantee”: under Selfridges 100% Fit Guarantee the Renter is entitled to a Rental Fee refund (less dry cleaning and Delivery Fees) should a Product item not fit. To claim the Fit Guarantee, the Renter must select “Request Fit Guarantee” found on their Dashboard within twenty-four (24) hours of the Rental Commencement Date to confirm the item does not fit. The Renter must then return the item within forty-eight (48) hours of the Rental Commencement Date, providing Selfridges with proof of postage. Selfridges will process any refund once proof of postage has been received. Late fees will apply in accordance with the “Fees and Charges” section below.

“Intellectual Property Rights”: patents, utility models, rights to inventions, copyright and neighbouring and related rights, trademarks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets) and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.

“Member(s)”: any individual who has registered and been accepted to use the Selfridges Rental or the Bag Subscription Services.

“Product(s)”: products including, but not limited to, menswear and womenswear clothing and accessories.

“Rent/Renting/Rental”: to rent a Product(s) via Selfridges Rental in consideration for a Renter paying a Rental Fee and subject to these Terms.

“Rental Commencement Date”: the date on which the Rental of a Product begins. This is deemed to be the date the Rental is due to start as booked on the Services and as detailed in your confirmation email and account dashboard.

“Rental Fee”: means the fee to Rent the Product(s).

“Rental Period”: the length of time the Product is available for as set out by the Services. The Rental Period is measured from the date the Rental is due to start (and includes Bank Holidays, weekends and other holidays) to the day the Products must be posted back (before 12pm).

“Renter(s)”: a Member who wishes to Rent Products available through the Selfridges Rental Platform subject to these Terms.

“Renters' Terms”: the additional terms that apply to Renters which can be found here.

“Replacement Value”: a reasonable estimate of the current market value of a Product or Bag by Selfridges. Selfridges’ determination is final and binding on the Renter or Bag Subscriber. The estimate may change from time to time.

“Selfridges”: Selfridges Retail Limited, Selfridges, Selfridges Rental, we, us, our.

“Selfridges Rental”: means the rental concept offered by Selfridges to Selfridges’ customers via the Selfridges Rental Platform.

“Selfridges Rental Platform”: the website found at www.selfridgesrental.com and/or any other medium including, but not limited to, a mobile application, made available by Selfridges which can be used to access the Services.

“Service(s)”: means: (i) the Selfridges Rental Platform and services; (ii) Content provided through the Selfridges Rental Platform including facilitating the Renting of Products and use of the Bag Subscription Service by Selfridges’ customers.

“Security Deposit”: means the security deposit (applied to Products over a certain value) amount set by Selfridges which shall be held on the Renter’s payment card until the Product is returned and confirmed that it is in good condition with no damage.

“Terms”: means these Terms of Service, the third-party terms and conditions which are incorporated into these terms and conditions by reference, the Privacy Policy, the Cookie Policy the Renters’ Terms and/or the Bag Subscription Terms (as applicable).

“Third-Party Content”: means links or references to non-Selfridges websites, products, services or other materials or content specifically relating to third parties appointed to fulfil the provision of the Services or any aspect thereof.

“User(s)”: both Members and Visitors.

“Visitor(s)”: people who are visitors to the Selfridges Rental Platform and are not yet registered as Members.

WHO WE ARE

Selfridges Rental is a licensed platform, owned and operated by HURR Limited, a private limited company registered in England and Wales under company number 11262189 and with a registered office at 85 Great Portland Street, First Floor, London, W1W 7LT on behalf of Selfridges (“Hurr”). If HURR needs to contact you on behalf of Selfridges it will be by telephone or by writing and shall be sent to the email or postal address you have provided to us when you registered. We will endeavour at all times to use the method of contact indicated by you as your preferred method of contact.

We value hearing from our Users and are always interested in learning about ways we can improve the Selfridges Rental Services, please feel free to email us at [email protected].

When we use the words writing or written in these Terms, this includes email.

When you use Selfridges Rental:

When Renting a Product or Bag you understand that you are part of a contract with Selfridges, that this contract is a binding agreement and that you will abide by both these Terms, and in particular the Renters’ Terms and/or Bag Subscription Terms (whichever is applicable).

You accept that you are wholly and exclusively responsible for complying with the Terms, particularly the Renters’ Terms and the Bag Subscription Terms. You agree to indemnify Selfridges as a result of any loss or damage to any Products and/or Bags or arising from or relating to your use of the Services and you acknowledge and agree that Selfridges is not liable for any non-compliance on your part.

CHANGES

We retain the right to make changes to the Services and these Terms to reflect changes in relevant laws and regulatory requirements and to implement minor technical adjustments and improvements to the Services or the way we offer the Services to you, for example to respond to a security threat. These changes will not materially affect your use of the Services. You should revisit these Terms each time you use the Services in case they have changed.

We are always looking at ways to improve the Services to try and find new and innovative features and improvements to our services. In order to do this, we may need to update, reset, stop offering and/or supporting a particular aspect or feature of the Services. These changes may affect your past activities, features you use and Content you have posted and any other information you have submitted to the Selfridges Rental Platform. Once we have made the changes to any part of the Services, your continued use of the Services will show that you have accepted any changes to the Services.

In the event that we make any significant changes to the Services or these Terms, we will notify you and you may have the right to end these Terms before the changes take effect.

ACCESS AND AVAILABILITY

We will use all reasonable endeavours to ensure that the Services are fully operational at all times. However, we do not guarantee that the Services or any Content on it, will always be available or be uninterrupted.

Access to the Services are permitted on an “as is” temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Services without notice. We will not be liable to you if for any reason the Services are unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the Services. You are also responsible for ensuring that all persons who access the Services through your internet connection are aware of these Terms and other applicable terms and conditions, and that they comply with them.

We reserve our right to restrict, suspend or terminate your use of the Services or any of our other services at any time if we believe, in our absolute discretion, that you have breached these Terms and other applicable terms and conditions.

USE OF THE SELFRIDGES RENTAL PLATFORM

A. Registration

In order to access and make use of the full range of Services, you will be required to setup an account and register to become a Member by completing a Selfridges-generated registration form. You will be required to supply certain information, including but not limited to, personal information, in order to complete the registration form successfully. After you have successfully completed the registration form, you will be provided with an account and login information to enable you to access the Services or be added to a waitlist to access the Services. You are the only person authorised to access and use your account.

Selfridges is under no obligation to accept any individual as a Member and reserves the right to accept or reject any membership application at our sole and complete discretion. You will also have the opportunity to sign up for marketing emails to hear about all of the latest news and styles at Selfridges Rental (you can unsubscribe at any time by clicking the link in any emails you receive from us). In order to make full use of the Services and to enable Selfridges to comply with its legal obligations, we may request that you provide us with identity documentation (e.g. passport) to verify your identity. Passbase is our third-party verification provider and will complete the identity verification process. By registering to become a Member for the purpose of using the Services, you accept that the Passbase terms of service form part of these Terms and are incorporated by reference. We also use Stripe as our third-party payment processor and by registering to become a Member for the purpose of using the Services, you accept that the Stripe’s terms of service form part of these Terms and are incorporated by reference. We reserve the right to send any identity documentation provided to us by our verification provider, Passbase, through to our payment processor, Stripe, and you acknowledge that this is necessary in order to provide the Services. We recommend that you review and familiarise yourself with both Passbase and Stripe’s privacy policies which outline how they use your personal data. If you have any questions in relation to either or both of these privacy policies, we encourage you to contact these providers directly. For your ease of reference, you can read more about how Passbase will manage your personal data here, and how Stripe will manage personal data here. If you do not agree to the processing of your personal data in accordance with these third-party providers’ terms and conditions, you will be required to cease using the Services immediately.

You acknowledge that in order to create an account and become a Member, you must be over 18 years of age and you represent and warrant to Selfridges that you are over 18 years of age and have the legal capacity in the United Kingdom to enter into a legally binding agreement.

If you are registering an account on behalf of a company or other entity, you represent and warrant that:

you have the necessary authority and capacity to bind the company or entity;

you are entitled to give us the licenses and permissions required under these Terms;

all information and details provided by you to us at the point of registration or otherwise are true, accurate and up to date in all respects.

You can update or correct your personal details or the details in respect of a company or another entity at any time in your User dashboard when you are logged in or by emailing us at [email protected]. You are responsible for maintaining the confidentiality of your account details and for any activities that occur under your account. If you have any concerns that your account has been misused, you should contact us at [email protected].

You represent and warrant that you have all relevant rights, licenses and/or approvals in relation to any material or Content you post on Selfridges Rental Platform.

We are under no obligation to accept any individual as a Member and may accept or reject any membership application at our sole and complete discretion. In addition, we reserve the right to deactivate your account at any time, including without limitation, if it is determined that a Member has violated these Terms, or any aspect thereof.

Unless authorised by Selfridges in writing, you may only register one (1) account.

B. Unauthorised use of accounts and changes to information

You agree to notify Selfridges immediately if there are any changes to the information you provided when becoming a Member or if you learn or have reason or knowledge to suspect that unauthorised use of your account or any other activity which could be reasonably classified as a breach of security has occurred, is occurring or is likely to occur. You are solely responsible for maintaining the confidentiality and secrecy of your account login details and are fully and solely responsible for all activities that occur under your individual account.

You represent and warrant that all information provided at the point of registration is truthful and accurate and you undertake to update any untruthful or inaccurate information as soon as reasonably practicable should you become aware that any information is untruthful or inaccurate. We reserve the right to refuse to grant you a particular username for any reason, including, but not limited to, if such username: is impersonating someone else, is protected by a trademark or other intellectual property rights, is vulgar or otherwise offensive to any individual or group of individuals, is unsuitable, discriminatory, threatening, abusive, defamatory, obscene, inappropriate, infringing, indecent or otherwise does not comply with these Terms.

You agree and undertake not to use the Services or any aspect thereof to:

(a) transmit any content, information or other materials that are, or which Selfridges considers in its sole discretion to be, unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, offensive, obscene, pornographic, hateful or threatening to any group defined by race, religion, gender, national origin or sexual orientation, lewd, lascivious, violent, harassing or otherwise objectionable, including without limitation, expressions of bigotry, prejudice, racism, hatred or profanity;

(b) introduce viruses, trojans, worms, logic bombs and/or any other material which is malicious or technologically harmful to the Services or its Users;

(c) display material that exploits children under the age of eighteen (18);

(d) copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way services, web pages or materials on the Selfridges Rental Platform or via the Content or otherwise Infringe Selfridges' Intellectual Property Rights;.

(e) post, collect or disclose any data from the Services other than in accordance with these Terms and applicable law;

(f) post, collect or disclose any personally identifying information (including account names) or private information about children or any third parties without their consent (or their parent's consent in case of a child under eighteen (18) years of age);

(g) post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation, including without limitation, solicitations of credit card numbers, or promotion of raffles or contests;

(h) violate these Terms, or any applicable domestic or international laws or regulations;

(i) use our Services or Content to develop a competing service or product;

(j) gain unauthorised access to the Services, the server on which our Services is stored, or any server, computer or database connected to the Services;

(k) attack our Services via a denial-of-service attack or a distributed denial-of service attack; a breach of this provision is a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, which shall be determined by us in our sole discretion, your right to use our Services will cease immediately without further notice to you;

(l) use the Services to intentionally deceive other Users;

(m) use the Services if we have suspended or banned you from using it;

(n) infringe the Intellectual Property Rights of Selfridges or any third-party;

(o) share or otherwise upload or communicate any misleading or false information or messages of any kind;

(p) interfere with the proper working of the Services;

(q) use any robot, spider, scraper or other automated means to access the Services and/or collect Content or data for any purpose; or

(r) bypass, disable or attempt to disable any security measures used in connection with the Services.

(s) return any counterfeit Products or Bags or otherwise infringe the copyright, trademark or other rights of third-parties;

(t) write and post reviews that are anything other than true and accurate to the best of your knowledge; or

(u) impersonate any person or misrepresent your affiliation with a person or entity.

You indemnify Selfridges against any claims made or threatened against Selfridges by another person on the basis of your breach of the Terms.

You also agree and undertake that you will not and will not attempt to or permit any third-party to: use any device, software, malicious code or destructive routine intended to damage or otherwise interfere with the proper functioning of the Services or any aspect thereof, including without limitation, servers, third-party services or networks connected to our Services or take any other action that interferes with any other User’s use of our Services. You will not attempt to reverse engineer, decompile, disassemble, translate, interfere with, derive the source code, algorithms or underlying ideas of the Selfridges Rental Platform and its Services, any part thereof or access thereto.

C. Account security

The Selfridges Rental Platform contains a feature which allows you to store your login credentials in your browser so that you can log in automatically and conveniently each time you access Selfridges Rental Platform. You acknowledge and agree that you will be responsible for any damage or loss to Selfridges or the Services arising from or relating to unauthorised access to the Services from your account and you hereby agree to indemnify Selfridges against any claims made or threatened against Selfridges, or any loss or damage arising from or relating to such unauthorised access. Selfridges will have no liability to you or any third-party for damage or loss related to or arising from such unauthorised access or use.

Your account may not be shared with or transferred to another: it is for your personal use only. You must keep your account details secure and you are solely responsible for all activities carried out on or through your account. If you do not take all reasonable steps to protect your account information, Selfridges is not liable for any losses arising from or relating to your account being accessed or used by someone else.

D. Interruptions to the Services

The Services may be subject to limitations, delays and other problems inherent in the use of such communications facilities and you acknowledge, without limitation, that:

your use of the Services will not be uninterrupted or error-free;

there may be delays, omissions, or inaccuracies in the Services;

from time to time the Services may become unavailable due to maintenance requirements, malfunction or otherwise; and the Services will not be free from vulnerabilities or viruses.

Selfridges shall not be responsible or liable to you for any loss or damage arising from or relating to delays, delivery failures, or any other loss or damage arising from or relating to the transfer of data over communications networks and facilities, including the internet.

INTELLECTUAL PROPERTY

We are the owner or the licensee of all Intellectual Property Rights in the Services, any services associated with it, the Content and in the material published on the Selfridges Rental Platform (including text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software). Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Unless any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply, Users agree not to otherwise reproduce, duplicate, copy, resell or in any other manner re-use or exploit any part of our Services or the Content on the Selfridges Rental Platform unless given express written permission to do so by us.

Subject to your agreement and compliance with these Terms, you are granted during the term of this agreement a non-transferable, non-exclusive, non-sublicensable license to access and use the Services for your personal use.

You understand that your use of the Services does not confer on you any Intellectual Property Rights held by Selfridges and/or its licensors. You are merely given a license to use the Services in accordance with these Terms.

You will not use the material on our Services save as in accordance with these Terms. It is your sole responsibility to ensure you have all necessary rights and licenses to use and/or submit materials and Content to the Services.

You must not extract or otherwise use any Content or data on the Selfridges Rental Platform for commercial purposes.

You agree that you shall not under any circumstances harm, tarnish or damage the Selfridges’ brand or perception of Selfridges in any way, knowingly or otherwise, by unauthorised use of the Services or Content, register or use any trademarks, domain names, trade names or derivations thereof that may imitate or are similar enough to those owned by Selfridges as to be confusing.

E. Selfridges’ Content

All Content and information available through the Services, including but not limited to, Product and Bag descriptions and specifications, Product and Bag photos, advice from stylists and photos is available to you on an “as is” basis and is to be used for general information purposes only.

Such information is provided on an anonymous basis, without any knowledge as to your identity or specific circumstances. We may update the Content, including Product and Bag descriptions and specifications, as we deem appropriate and without notice to you.

F. Third-Party Content

The Services may contain links or references to non-Selfridges websites, products, services or other materials or content. This Third-Party Content is provided to you as a convenience, and Selfridges is not responsible for any Third Party Content or the actions of those that provide or use such Third-Party Content. Any Third-Party Content is independent from Selfridges, and Selfridges has no control over the Third Party Content.

In addition, a link to any Third-Party Content does not imply that Selfridges endorses, approves of or accepts any responsibility for the Third-Party Content or its provider, or vice versa. You acknowledge and agree that we will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, in connection with, resulting from your use of or reliance on any such Third-Party Content available on or through our Services. We strongly encourage you to review any separate terms of use and privacy policies governing use of these third-party websites and Third-Party Content.

G. Fair Dealing Policy

No part of the Services, including the Content, may be reproduced or transmitted in any form, by any means, electronic or mechanical, including photocopying and recording, except that Selfridges authorises you to view, copy, download, and print Content (such as press releases and FAQs) that is available on the Services, provided that: (a) you use the Content solely for your personal, non-commercial, informational purposes; (b) you do not modify the Content; and (c) you do not remove any copyright, trademark, and other proprietary notices on the Content.

MEMBERS’ LIABILITY

These Terms do not limit your liability for fraudulent misrepresentation, death or personal injury resulting from your own negligence.

You are responsible for having sufficient funds available to either replace the Product(s) or Bag(s) should you lose or damage the Product(s) or Bag(s), up to the Replacement Value. If you are unsure what the Replacement Value of the Product is, please contact Selfridges for the Replacement Value before booking your Rental or selecting your chosen Bag under the Bag Subscription Service.

The relevant funds will be taken from your account to cover such charges without your permission being sought. DO NOT RENT AN ITEM(S) OR SIGN UP FOR THE BAG SUBSCRIPTION SERVICE UNLESS YOU HAVE SUFFICIENT FUNDS TO COVER THE REPLACEMENT VALUE.

Selfridges has the discretion to set an appropriate Replacement Value for any Product or Bag which shall be determined in good faith. The figure determined by Selfridges is binding and may be subject to change.

We have the right to take funds corresponding to the Replacement Value from your account without seeking further permission from you if we reasonably believe you have caused damage to the Product or Bag, or are unable to return it for any reason within the deadline set by us from time to time.

Selfridges may contract a debt collector or file a claim via the courts to collect any outstanding payment that you have refused to pay for the damage or loss you have caused within the timeframe set and the charge for their service shall be added to the debt that we are collecting from you.

SELFRIDGES’ LIABILITY

The Terms within this agreement do not limit our liability for fraudulent representation, death or personal injury from the negligence of our agents or employees.

Selfridges shall exercise all reasonable care and skill in connection with the Services.

Selfridges shall not be responsible for the following:

any secondary or indirect loss, consequent to a direct damage, which was not reasonably foreseeable upon entering the contract; any loss which did not result from our direct breach;

the failure to meet our obligations or to provide the Services under this agreement where failure has occurred from events that were not in our control. Meaning a circumstance where the cause was beyond our reasonable control which became an obstacle to completing the Services not confined to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity, epidemic, pandemic and acts of God.

We explicitly exclude any and all conditions, warranties, or representations both implicit or explicit relating to quality, merchantability, durability, fitness for purpose, and those arising by statute.

Any direct damages that are suffered as a result of your use of the Services (including the Selfridges Rental Platform and Content) shall be limited to the monies you have paid to Selfridges in connection with your use of the Services during the three (3) months immediately preceding the events giving rise to the claim.

Selfridges is not responsible for any delays in the delivery or return of the Product(s) Rented or Bags rented, or any loss or damage should the delivery information and location provided by you be unsecure or unsuitable.

STOPPING YOUR USE OF THE SERVICES

You may cease using the Services at any time (outside of any active Bag Subscription or Rentals) by requesting that your account be deactivated via email at [email protected]. You understand that your Content may continue to exist and be used on or through the Service even after such deactivation.

DISPUTES

Disputes between you and Selfridges:

In the event that you have a dispute with us, please contact us directly so that a resolution can be found.

H. Informal Dispute Resolution

Both you and Selfridges agree that in the event of any dispute between you and us, the aggrieved party will first contact the other party and make a good faith sustained effort to resolve the dispute before resorting to more formal means of resolution.

I. Formal Dispute Resolution

In the unlikely event that we have not been able to resolve a dispute informally, you and Selfridges each retain the right to seek relief in the small claims court.

Any claim, dispute or matter arising under or in connection with these Terms shall be governed and construed in all respects by the laws of England. You and Selfridges both agree to submit to the non-exclusive jurisdiction of the English courts.

THIRD-PARTY RIGHTS

This agreement has not given any right under the Contracts (Rights of Third Parties) Act 1999. This does not affect any right or remedy that has been stated within this agreement or exists separate to the Act.

PERSONAL INFORMATION

Through using the Services, you agree and understand that we may collect, transfer, store and use your personal information in accordance with our Privacy Policy. The website is operated by HURR Limited who collect and use cookies for the operation of the website. GENERAL

Selfridges may take the following actions as necessary:

cancel any Rentals or Bag Subscription, confirmed or otherwise;

refuse to list or remove from the Services any customer review, or other Content at Selfridges’ sole discretion;

temporarily suspend or permanently remove your account from the Services if you have:

breached these Terms, applicable laws, regulations or taxation requirements;

repeatedly cancelled Rentals;

failed to return a Bag, returned a counterfeit bag rather than the rented Bag, or returned a Bag later than the permitted rental period;

provided fraudulent, inaccurate, incomplete or outdated information at any point.

The above steps may be taken at the absolute discretion of Selfridges. We may transfer rights under the Terms to a third-party without your prior consent.

Our Terms do not create an employment relationship, partnership, agency or joint venture between us and any Member.

We reserve the right to take action against you for breach of these Terms, even if action is taken at a later date.

These Terms shall prevail over any and all preceding agreements. You understand you are not able to rely on any prior agreements. You understand that your right to use the Services is subject to all applicable laws of the country in which you reside, and you agree that you shall comply with all applicable laws at all times in connection with the Services.

In the event that any part of these Terms are found by a court to be unreasonable, unenforceable or void, that part shall be severed, and the remainder of the clauses shall be enforceable with such deletion or modification as may be necessary to make it effective and for such period as is found to be reasonable and valid.

Notice to us must be sent by email to [email protected]. Notice to you shall be sent via email to the address associated with your membership. This shall be deemed to be received on the following day after sending.

We, and any other third-parties appointed to fulfil the provision of the Services, may contact you by telephone calls or text messages, including by an automatic telephone dialing system, at any of the telephone numbers provided by you but only in respect of the Services. Standard message and data rates charged by your mobile carrier may apply to the text messages we send you.

BAG SUBSCRIPTION TERMS

The Bag Subscription Service is an online service that allows customers to access one bag per month of their Bag Subscription Term (as defined below) to rent designer bags for either a three (3) or six (6) month period.

The following Bag Subscription Terms between the customer (“you”, “your”) and Selfridges Retail Limited (“we”, “our”, “us”, or “Selfridges”) describes the terms and conditions on which you may rent Bags from us through the Bag Subscription Service.

By accessing or using any of the Services, you acknowledge that you have read, understood and agreed to be bound by these Bag Subscription Terms. Capitalised terms not defined herein shall have the meaning assigned to them in our Terms of Service. The provisions of the Bag Subscription Terms shall, to the extent possible, be interpreted so as to supplement the other Terms and to avoid any conflict between them. In the event of a conflict between these Bag Subscription Terms and the other Terms, for use of the Bag Subscription Service, the Bag Subscription Terms shall take precedence.

All Users are required to read, accept and agree to comply with and be bound by these Bag subscription Terms. If you do not wish to accept the Bag Subscription Terms, or any aspect of these Terms, you should stop using the Services immediately.

A. REGISTER YOUR INTEREST

  1. You may register your interest to join the Bag Subscription Service through the Selfridges Rental Platform by submitting your name and email address to us on the “bag subscription” landing page on the Selfridges Rental Platform.

  2. Once you have registered your interest, you will be added to the waitlist for the Bag Subscription Service.

  3. There are a limited number of Bag Subscriptions available to customers on a first come first serve basis with priority given to “Selfridges unlocked” customers. You will be informed when you have been progressed from the waitlist stage.

B. CREATE YOUR ACCOUNT

  1. Once progressed from waitlist stage, you can sign up for the Bag Subscription Service in full by creating an account, as set out in the “Registration” section above.

  2. By creating an account, you represent that you are eighteen (18) years or older and reside in mainland UK.

  3. You are solely responsible for maintaining the accuracy of your account information on our site.

  4. Responsibility for the security of your account information and access is solely down to the named individual on the account. You are responsible for all activities, including purchases under your account, whether or not you authorised them. We accept no liability for any loss or damage from unauthorised access or use.

  5. It is your responsibility to notify us of any unauthorised use or access of your account known or suspected by you.

  6. Applicants who are accepted to use and pay for the Bag Subscription Service via the identification check process stated above under “Registration”, will be deemed a Member unless terminated in accordance with these terms.

  7. We have the right to suspend, terminate, or remove you as a Member at any time at our own discretion due to any of the reasons that are or are not defined in these terms.

  8. If you have been previously accepted as a Member through the Rental Service and therefore have already completed the account and ID verification stage, upon registering your interest you will join the waitlist until you are invited to subscribe to and pay for the Bag Subscription Service.

C. SUBSCIPTION PAYMENT

  1. All payments for the Bag Subscription Service are collected by our third-party payments provider Stripe, as detailed in the Terms.

  2. All payments for the Bag Subscription Service are taken in GBP and are inclusive of UK VAT and the Bag Protection Cover (detailed below).

  3. By signing up to the Bag Subscription Service, you agree to us charging your chosen payment method upfront with the relevant subscription fee for your Bag Subscription. You will be charged on the same calendar date that you signed up for the Bag Subscription Service.

  4. By signing up to the Bag Subscription Service, you agree to a minimum term of either: (a) 90 days for the three-month Bag Subscription; or (b) 150 days for the six-month Bag Subscription, both minimum terms are calculated from the chosen delivery date of your first Bag (each a “Bag Subscription Term”).

  5. By signing up to the Bag Subscription Service, you agree to having an active method of payment on your account at all times.

  6. Any fees owed to us (including but not limited to the subscription fees and any other fees detailed in the Charges section below) shall be charged directly to your payment method on account. Any refunds due to you shall be refunded to the original payment method.

  7. You have a 14 day cancellation right to cancel your Bag Subscription and receive a full refund for the subscription fees, this 14 day period shall be calculated from the date of payment for your Bag Subscription (the “Cooling Off Period”). If you decide to cancel your Bag Subscription during the Cooling off Period then you must notify us in writing to the following email address: [email protected].

  8. If you exercise your cancellation right after you have had your first Bag delivered, you will only be entitled to a pro rata refund of the subscription fees attributed to the future Bags you have not yet received as part of your Bag Subscription.

D. BAG SELECTION

  1. Upon making payment for your Bag Subscription, you will be prompted to select all three or six Bags to be rented throughout your Bag Subscription Term. All Bags are subject to availability.

  2. You may change the Bag selected for the following month of your Bag Subscription Term up until four (4) days before the Monthly Start Date (defined below).

  3. You may not select the same Bag to be rented for two consecutive months of your Bag Subscription Term.

  4. You may choose the delivery date of your first Bag. The start date of your Bag Subscription shall be from the chosen delivery date of your first Bag (“Bag Subscription Start Date”).

  5. You will be able to rent your first Bag for a period of four weeks from either: (i) the Bag Subscription Start Date (if it’s your first Bag of your Bag Subscription); or (ii) the chosen delivery date of that month’s Bag (if it is the second Bag onwards of your Bag Subscription) (both known as “Monthly Start Date”) for a period of four weeks (“Bag Rental Period”).

E. THE BAGS

  1. All Bags offered via the Subscription are in new or pre-owned condition. Any signs of wear and tear on a Bag are described and photographed in the relevant product listing on the Selfridges Rental Platform.

  2. We supply the Bags to you under the Bag Subscription Service for private use only and not for commercial use.

  3. All of our Bags are 100% genuine and are certified by external authentication services.

  4. The Bags are as described in the listings on Selfridges Rental, however, the Bags may differ slightly from these photographs. By renting a Bag through our Bag Subscription Service, you agree that these photographs are only indicative of the exact quality of the Bag.

  5. All of our Bags are specially cleaned and maintained after each time they have been used by Members.

  6. All of our Bags are forensically marked and checked via RFID tags for authenticity each time they are sent and received back between Bag Rental Periods from Bag Subscribers.

  7. We will, by the use of photography and video, record the condition of the Bag each time it is sent and received back between Bag Rental Periods from Bag Subscribers. This will be kept on our records and used as a comparison of condition and kept as evidence.

F. DELIVERY/RETURN OF BAG

  1. We will only deliver the Bag to the address authorised by you when signing up for the Bag Subscription Service.

  2. Each Bag will be sent via our nominated delivery provider on a tracked and signed-for delivery service.

  3. This is a UK-based service only (including Northern Ireland), and we will not arrange collection or delivery to any address outside the UK.

G. RETURNS

  1. You have two (2) days to return the Bag in your possession back to us, commencing from the date after your Bag Rental Period expires.

  2. You must return the Bag to us via the pre-paid labels provided to you on delivery of the Bag.

  3. You must return the original Bag to us in the packaging provided on delivery.

  4. You will be informed of the date by which each Bag must be returned by post (“Bag Return Date”). If you fail to return the Bag via the pre-paid method by the Bag Return Date, we:

    1. will not dispatch your next Bag to you; and

    2. reserve the right to charge you a late fee equal to £25 per calendar day (the “Late Fee”) calculated from the day after the Bag Return Date, until the date by which the Bag has been returned and we have provided you with confirmed receipt of the Bag.

  5. If the Bag has not been returned by four days after your next Bag Rental Period was due to start, your Bag Subscription will be paused indefinitely and your upcoming Bag bookings will be released to other Bag Subscribers. You will continue to accrue Late Fees until the Bag is returned.

  6. Any Bags not returned after 4 weeks from the Bag Return Date will be considered as not returned, and therefore the Member will be charged the Replacement Value of the Bag and your details will be passed to a third party debt collection company to recover the Bag and the Replacement Value.

  7. Once your Bag has been returned to us, and it has passed our condition checks, we’ll arrange delivery of your next Bag. Your next Bag Rental Period will begin on the chosen delivery date of your next Bag.

  8. We prefer that items are returned to us via our own service or nominated courier partner so that they are protected and insured. If you decide to return the Bag using any other third-party providers this will be at your own expense and we are unable to accept liability or responsibility for these.

H. CHARGES

  1. Your Bag Subscription automatically includes damage protection, which covers minor damage and wear and tear of any Bag you rent through the Bag Subscription Service up to a repair cost of £50, such repairs costs to be solely determined by us (“Bag Protection Cover”). The Bag Protection Cover does not cover loss or theft of a Bag during your Bag Rental Period or damage beyond repair to a Bag during your Bag Rental Period.

  2. Once a Bag is returned and inspected by us, if any damage or wear and tear is found to be more severe than what can be covered under the Bag Protection Cover, you will be charged directly via your payment method for the fees to repair such damages (the “Damage Fee”). We will inform you of the cost of the Damage Fees applicable to you for the relevant Bag that has been damaged.

  3. If the Bag is deemed by us to be damaged beyond repair then you are immediately liable for the Replacement Value of the Bag and we reserve our right to terminate your Bag Subscription for this reason.

  4. The Bag for your next Bag Rental Period will not be delivered to you until any outstanding Damages Fees or Replacement Value of the Bag (where relevant) are paid by you.

I. LOST, STOLEN OR COUNTERFEIT BAG

  1. In case of loss, theft or any damage during the Bag Rental Period, you are required to contact us immediately on [email protected].

  2. We will conduct an investigation into any counterfeit, lost or stolen Bags during your Bag Subscription and may:

    • (a) inform the relevant authorities;

    • (b) report the Bag(s) as stolen; and

    • (c) take steps to recover the Replacement Value from you.

  3. You agree that if you return a counterfeit bag to us in the place of the original Bag we sent to you, we will:

    • (a) consider the bag to be stolen;

    • (b) take steps to recover the Replacement Value of the bag from you; and

    • (c) notify the relevant authorities.

  4. We have the right to suspend, terminate, or remove you as a Member at any time at our own discretion due to any of the reasons that are or are not defined in these Terms. If an account is under investigation for loss or damage of a Bag or return of a counterfeit bag rather than the rented Bag, the Member will not be granted any Bags to rent and their Bag Subscription will be terminated with immediate effect.

If you are dissatisfied with the Bag Subscription Service, or the terms of this Bag Subscription Agreement, your only remedy under these Bag Subscription Terms shall be to terminate your Bag Subscription and return our Bags and to discontinue your use of the Bag Subscription. Without limiting the preceding sentence, we shall have no liability for any failure or delay resulting from any matter beyond our reasonable control.

RENTERS’ TERMS

Selfridges Rental is an online service that allows customers to access an unlimited wardrobe to rent. Selfridges Rental allows customers to trial new designers and rent for 4, 8, 10 and 20 day periods (or any other specified period offered).

The following Rental Terms (“Rental Terms”) between you and Selfridges Limited (“we,” “our,” “us,” or “Selfridges”) describes the terms and conditions on which you may rent Products from us through the Selfridges Services. By accessing or using any of the Services, you acknowledge that you have read, understood and agreed to be bound by these Rental Terms. Capitalised terms not defined herein shall have the meaning assigned to them in our Terms of Service. The provisions of these Rental Terms shall, to the extent possible, be interpreted so as to supplement the Terms and to avoid any conflict between them. In the event of a conflict between these Rental Terms and the Terms, the Terms shall take precedence.

All Users are required to read, accept and agree to comply with and be bound by these Terms. If you do not wish to accept these Terms, or any aspect of these Terms, you should stop using the Services immediately. Selfridges reserves the right to make changes to the Services and to these Terms which will not materially affect your use of the Services. Selfridges strongly recommends that you revisit these Terms each time you use the Services to familiarise yourself with any amendments. Once we have made the changes to the Services and/or these Terms, acceptance will be inferred from your continued use of the Services. In the event that we make any significant changes to the Services and/or these Terms, we will notify you in writing and provide you with an opportunity to cease use of the Services before the changes take effect.

1. YOUR ACCOUNT

A. General Conditions

You may rent Products available through the Selfridges Rental Platform.

You must sign up and register to be entitled to rent any Products.

By agreeing to these Rental Terms, you represent that you are eighteen (18) years or older and that you are authorised to use the chosen payment method or the purpose of renting Products as described in these Rental Terms.

You agree and understand that we may collect, use, store and process your personal information in accordance with our Privacy Policy.

B. Condition: Use of the Products

All Products will be professionally cleaned and delivered ready to wear.

Selfridges will ensure that Products are laundered (including wet and dry cleaning methods) and quality controlled. However, use of the Product is at your own risk and Selfridges shall not be held liable for any health-related complaints associated with any Product. You agree to treat the Products with the utmost care, as if it was borrowed from a close friend.

You are responsible for loss, destruction or damage to the Products due to theft, mysterious disappearance, fire, major stains or any other cause.

However, and for the avoidance of doubt, you will not be liable for normal wear and tear, which encompasses minor stains, rips, missing beads, stuck zippers or other minor damage, where you have purchased the optional Damage Protection Charge at checkout.

If you return a Product that is damaged beyond normal wear and tear, then you agree that we will charge you, and you shall pay, for the price for repairing or replacing the Product, the price of which will determined at our sole discretion.

C. Rental Returns

With each delivery of Products, we send you a prepaid postage label, which you shall use to return all of the Products you have rented. You agree to return any Product using the reusable Return Packaging provided by Selfridges at point of delivery.

D. Changes to Account: Termination

You acknowledge and agree that we may limit your account, including but not limited to, restricting orders placed under a single customer account, payment card, or billing or delivery address.

We reserve the right to limit, cancel, restrict or remove any account or rental of Products for any reason in our sole discretion, including but not limited to Product availability, identity verification concerns and geographic concerns.

We reserve the right to modify or terminate your account at our sole discretion and without prior notice.

E. Deletion of Account

To request the deletion of your account, email [email protected]. As soon as you request to delete your account, you will not be able to receive any additional Products through our Services.

You may continue to keep Products you have already received, but you must return to Selfridges all such Products on or before the last day of the Rental Period during which you requested Selfridges to delete your account.

If we do not receive your items within 10 working days of the end of the Rental Period, you will be charged up to the Replacement Value of the Product.

You will not be entitled to any refund on any Rental Fees you have paid.

You will be unable to request to delete your account if there is an active rental through our Services or you are still in possession of any Products.

2. DELIVERY AND RETURNS

All deliveries will be through Selfridges’ delivery partners, which may change from time to time at Selfridges’ discretion.

The delivery method used will be at the discretion of Selfridges.

Selfridges or its delivery partners will contact you with a tracking number that provides information about estimated delivery and arrival times of Products through the Services.

With delivery of the Products, Selfridges will provide you with a prepaid, pre-addressed reusable return packaging (the “Return Packaging”) as well as instructions for your use in returning the Products to Selfridges.

If you lose the Return Packaging, please contact us at [email protected] to request new Return Packaging. Selfridges may, at is sole discretion, charge you for the cost of the lost Return Packaging.

Should any Product not be returned in the Return Packaging provided, Selfridges at its sole discretion will charge you for the cost of Packaging as an additional fee using the payment method on file and without any further notice to you.

3. PROMOTIONAL ACTIVITIES

Any sweepstakes, contests, raffles, surveys, games, or similar promotions (collectively, “Promotions”) made available through the Services may be governed by rules that are separate from these Rental Terms. If you participate in any Promotions, please review the applicable rules, as well as our Privacy Policy. If the rules for a Promotion conflict with these Rental Terms, the Promotion rules will take precedence.

RENTER’S FEES AND CHARGES

There are four applicable fees to any Rental transaction:

The optional Damage Protection Charge; and

The Security Deposit - once the Product has been returned and confirmed that it is in good condition with no damage, any applicable Security Deposit shall be returned within 10 days. In the event that damage is caused, you may be charged up to the Replacement Value automatically.

We work with Stripe to manage our secure payment process:

As payment is processed through Stripe, we require you to covenant that any details you are providing to us about your business or yourself are neither fraudulent nor inaccurate and you give Selfridges authorisation to share such information with Stripe. From time to time, Stripe may require further identification checks to enable you to use the Services and you will need to provide the further information requested.

All of the fees that apply are to be paid in Pounds Sterling and are subject to change over time. We will alert you to these changes by updating them on the Services.

Additionally, there may be changes to our fees during our promotional events or if any new Services are added.

If you do not post back the Product before 12pm on the final day of the Rental Period, you agree you will be charged the following fees:

a £25 late fee each day after the last day of your Rental;

the applicable Rental Fee pro rata to the number of days you keep the Product;

all applicable taxes to the transaction; and

any reasonable legal expenses incurred by Selfridges or its partners in retrieving the Product(s).

The funds will be taken from your account to cover such charges without your permission being sought.

RENTER’S CANCELLATION POLICY

If you decide that you no longer want to Rent a Product, then subject to the below, you can cancel free of charge within forty-eight (48) hours of your Booking Date by visiting the My Rentals section of your account or by sending us an email to [email protected] with full details on the Rental you wish to cancel.

If you wish to cancel after this forty-eight (48) hour period, you will receive a refund, minus the Cancellation Charge.

Any cancellation made within forty-eight (48) hours of the Rental Commencement Date will not be reimbursed.

In the event that your Booking Date and the Rental Commencement Date are within the same forty-eight (48) hour period, you are permitted to cancel the Rental within two (2) hours of the Booking Date without penalty. Once the two (2) hours has elapsed, you are unable to cancel the Rental free of charge and you will be liable for 100% of the applicable Rental Fee and Delivery Fees. Any Security Deposit being held shall be returned to you within seven (7) days of cancellation.

If we reasonably believe that you Rented a Product with the intent to perpetrate a theft or to cause any other harm, we have the right to cancel a Rental without notice and charge the Renter a sum we deem appropriate, up to the Replacement Value. We reserve the right to use our discretion to determine the appropriate sum in each instance.
